1. RELEASE AND WAIVER OF LIABILITY
In consideration of participation in the Event, I (or, if applicable, my child named below) RELEASE AND FOREVER DISCHARGE AND HOLD HARMLESS THE PROPERTY OWNER, GGP SERVICES INC., AND THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, PARENT COMPANIES, OFFICERS, DIRECTORS, AGENTS, TENANTS, EMPLOYEES, SHAREHOLDERS, SUCCESSORS AND ASSIGNS, AND PROMOTIONAL AGENCIES (COLLECTIVELY THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTIONS, SUITS, DAMAGES, COSTS AND EXPENSES FOR ANY AND ALL PERSONAL INJURIES, LOSS OF PROFIT, PAIN AND SUFFERING, PROPERTY DAMAGE, THEFT OR OTHER LOSS ARISING OUT OF OR OCCURRING IN CONNECTION WITH PARTICIPATION IN THE EVENT.
I acknowledge that this Event may involve risks and dangers of serious physical bodily injury. The risks may include, but are not limited to, those caused by equipment, lack of hydration, actions of other people including other participants and instructors. To the extent permitted by applicable law, I HEREBY RELEASE, DISCHARGE, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL LIABILITY THAT MAY ARISE, DIRECTLY ORINDIRECTLY, NOW OR IN THE FUTURE, BY REASON OF ANY INJURY, DEATH, DAMAGE, LOSS,OR EXPENSE INCURRED IN CONNECTION WITH PARTICIPATION IN THE EVENT. This Waiver andRelease of Liability shall be binding on my heirs, executors, administrators, successors and assigns.
2. MEDICAL ACKNOWLEDGEMENT
I attest that I (or the minor Participant named below) do not suffer from any medical condition that might in any wayhinder or prevent full participation in the Event and that I am fully cognizant of the risks involved.
3. IMAGE RELEASE
I grant the Released Parties the right to photograph and videotape the Participant at the above-identified Event and to use, copyright, publish, reproduce, and distribute these images and recordings for any lawful purpose, including marketing the Mall, and in any manner or in any medium. I acknowledge that no compensation has been or will be received for this use.
4. ADDITIONAL TERMS
If the Participant is under the age of 18, I certify that I am the parent or legal guardian of the minor named below, have the legal authority to bind the minor to the terms of this Agreement, and agree to the terms on behalf of the minor. I acknowledge that the Event may be canceled at any time without notice and that the Participant will comply with Property rules and Event regulations. The Event, as defined herein, may include multiple days at the Propert and, if applicable, rehearsals.
5. ACKNOWLEDGMENT
I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT, INCLUDING THE FACT THAT I AM RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY ME (AND/OR THE MINOR PARTICIPANT) AND VOLUNTARILY AND FREELY AGREE TO THE TERMS AND CONDITIONS SET FORTH HEREIN. I INTEND THIS TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS RELEASE IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.
6. CHECK-IN VERIFICATION REQUIREMENTS
I understand and agree that participation in the Event is contingent upon providing Event staff, at check-in, with proof that this Waiver has been properly executed. Acceptable proof includes either a screenshot of the waiver confirmation/success message or a copy of the executed digital Waiver.
For adult Participants, the name on the executed Waiver or confirmation must exactly match the name appearing on the valid, government-issued photo identification that must be presented at check-in.
For Participants who are minors, I understand and agree that my child's participation in the Event is contingent upon my child presenting Event staff with proof that I, as the parent or legal guardian, executed this Waiver. Acceptable proof includes either a screenshot of the waiver confirmation/success message or a copy of the executed digital Waiver.
Failure to present the required proof of waiver execution and applicable identification at check-in will result in the immediate forfeiture of the Participant's right to participate in the Event.
